Part 1: Class Actions

Tuesday, Sept. 28, 2021 at 9:30 a.m. – 12:30 p.m.

Session Description: Litigation and class actions can have a harmful impact on credit unions.  This session provides an overview of trending class action developments along with information on how credit unions can protect themselves from the latest legal theories being asserted by plaintiffs, lawyers, and regulators.  The following class action trends will be discussed:
  • Overdraft/non-sufficient fund (NSF) fees
  • Guaranteed asset protection (GAP) insurance
  • Telephone Consumer Protection Act
  • Foreign transaction fees

Part 2: Risk Mitigation

Wednesday, Nov. 10, 2021 at 9:30 a.m. – 12 p.m.

Session Description:   Many credit unions look to an arbitration program to help minimize legal risks, and some credit unions are considering the implementation of arbitration clauses as a dispute resolution technique in resolving legal disputes. Learn more about adopting an arbitration clause in this session.  This session will also provide general risk mitigation strategies to help protect credit unions along with more specific strategies related to cybersecurity and employer HR risks in a changing workplace.  The following topics will be covered:

Part 3: Hot Regulatory Issues

Tuesday, Jan. 11, 2022 at 9:30 a.m. – 12:30 p.m.

Session Description: Credit unions face many regulatory changes and are burdened with the challenges of maintaining compliance with these changes.  This session explores several hot button regulatory issues and also provides information regarding recent bond claims that threaten the credit union industry.  Several of the topics include:
  • Cannabis banking
  • Regulation E – Electronic payment: Who is liable?
  • Consumer privacy and data
  • Cybersecurity

​Gina Carter, partner at Husch Blackwell, heads the firm's credit union team. Her credit union practice centers on all legal matters of interest to credit unions including vendor contracting, consumer finance, credit union mergers and governance. Gina also represents for-profit credit union service organizations (CUSOs) in areas including corporate structure, IP, data protection and privacy. She runs practices both in intellectual property (IP) and credit union law. She advises on all aspects of IP and has litigated cases in federal courts across the country. She remains a trusted advisor to people who first called upon her 25 years ago.
​Marci Kawski, partner at Husch Blackwell, has devoted her entire legal career to counseling providers of consumer financial services, including installment loan companies, motor vehicle finance companies, banks, credit unions, online lenders and short-term lenders throughout the country. She develops proactive compliance policies, procedures and strategies, consults on complex compliance questions, negotiates before state and federal regulatory agencies, and represents clients in individual and class claims regarding Fair Credit Reporting Act (FCRA) and Regulation V, Equal Credit Opportunity Act (ECOA) and Regulation B, Truth in Lending Act (TILA) and Regulation Z, Fair Debt Collections Practices Act (FDCPA), Telephone Consumer Protection Act (TCPA) and more.

Lauren Capitini, senior counsel at Husch Blackwell, helps financial services clients – including credit unions – align their business goals with federal and state regulations. She works closely with clients to meet their unique needs when drafting and reviewing lending and deposit contracts and disclosures, consulting on new product development, reviewing advertisements in various mediums, advising on check fraud matters and providing general guidance on complex regulatory issues. She helps clients resolve accusations of discrimination and fair lending laws and works with regulators in various capacities, including in the course of compliance examinations. Lauren is also well-versed in the subtleties of providing banking services to cannabis businesses and other unique parties such as service members, and directors and officers of banks.​
David M. Stauss, Partner at Husch Blackwell, focuses on complex business and commercial litigation in state and federal courts involving data privacy and security, product liability and business disputes. David has tried numerous cases in state and federal courts across the country securing favorable jury verdicts for clients. n his privacy and data security practice, David regularly assists clients in preparing for and responding to data security incidents, including managing multi-state breach notifications. Recognized as a top author in the area of privacy law, David is editor of the firm’s Byte Back blog. He also regularly counsels clients on complying with existing and emerging privacy and information security laws, including the European Union’s General Data Protection Regulation (GDPR), the California Consumer Privacy Act of 2018 (CCPA) and state information security statutes.

Sabrina Guenther Frigo, Lead Counsel for Privacy and Data Management at CUNA Mutual Group, advises on data privacy and cybersecurity issues throughout the data lifecycle, including legal and data governance requirements, privacy and security policies, contracts and service provider management, and data breach response. Prior to joining CUNA Mutual Group, Sabrina was a member of Jenner & Block LLP's Privacy & Information Governance Practice. There she advised global and domestic clients regarding data privacy and data security issues, specifically focusing on cross-border and global compliance efforts. Sabrina's background includes complex civil litigation, regulatory response, and international internal investigations, all skills and perspectives she actively incorporates into her privacy practice.

Carlos Molina, Senior Consultant, Risk & Compliance Solutions at CUNA Mutual Group, is responsible for assisting credit unions nationwide in identifying areas of risk in their operations and recommending appropriate controls to reduce loss exposures.  Prior to joining CUNA Mutual Group, Molina was a criminal investigator with the Public Defender’s Office in Essex County, N.J.  He also holds the following designations: Certified Risk Manager (CRM), Certified Fraud Examiner (CFE), CUNA certified Credit Union Compliance Expert (CUCE) and Credit Union Enterprise Risk Management Expert (CU-ERME).
